Wohnwagen Lohmann Rental Terms for travel between 01-Jan-2010 and 01-Jan-2011 Please note: If you do not book in the local currency of the country where your rental takes place the payment due dates will change and
your main vehicle rental charges will be payable in full upon confirmation of your booking.
This is to lock in the currency rate of the day you booked on and avoid further currency fluctuations. Some charges like taxes,
compulsory fees, extra items may still be payable upon pick up of your vehicle in their local currency.
(Please note, If you book in the local currency of the country where your rental takes place the standard payment terms described under the heading Payment Terms will apply.)
Insurance:
A Comprehensive insurance with 1.000, - EUR is included in our services.
Minimum age:
The driver must be at least 21 years old and at least one years in the possession of Class III or Class B license.
Deposit:
1.000, - € (= excess of the collision damage waiver) insurance will be refunded upon return without defects.
Final cleaning:
You can save the cost for the final cleaning! Only if the vehicle is not returned in the original proper state we have to charge you for additional cleaning (toilet: 50,- EUR, interior 80,- EUR, exterior 50 EUR).
Cleaning for trailers: Only if the trailer is not returned in the original proper state we have to charge you for additional cleaning (toilet: 50,- EUR, interior 30,- EUR, exterior 25,- EUR).
Smoking and Pets
All our motorhomes are non-smoking and we cannot tolerate the taking along of pets.
Price per kilometer:
300 km / day are free, for each additional kilometer we charge 0,33 EUR.
Charge of handing over:
We charge 70,- EUR (including two 11 kg propane gas bottles, chemicals for the toilet, water and the comprehensive introduction to the vehicle).
1. Reservation, Cancellation and Compensation
Reservations are binding once confirmed in writing by the lessor. If the required deposit is not paid fully, the lessor is eligible to cancel the rental agreement and claim compensation as described below. Without a deposit, the lessor is not obliged to provide the vehicle.
Should the hirer withdraw from the contract or cancel it prior to commencement of the rental contract the hirer is obliged to pay the following share of the contractually confirmed total rental rate as compensation; The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
Cancellation more than 93 days prior to commencement of rental: 10%, 34-93 days prior to commencement of rental: 20%, 17-33 days prior to commencement of rental: 50%, 16 days or less prior to commencement of rental: 90%. If the vehicle is not picked up by the hirer, then the full rental rate is due.
The lessor is permitted to charge a higher compensation, if the higher level of damages can be justified. The compensation may be reduced or waived, if the hirer can prove that the damage is lower or nonexistent. The hirer is permitted to name an alternative hirer to fulfill the contract, which the lessor is not obliged to accept if there is a justified reason. Subject to the
alternative hirer accepting and fulfilling the entire rental contract, then the compensation is waived.
Should the hirer return the vehicle with a delay, the lessor is permitted to claim compensation from the hirer (i.e. claimed compensation from following hirer). The hirer is not permitted to indefinitely extend the rental period without explicit written confirmation by the lessor. Any extension of the original contract period will result in an excess charge at the level of the
agreed rental rate.
An earlier return of the vehicle prior to the agreed return date still requires the rental fee to be paid in full according to the rental agreement, subject to the fact, that the lessor can not rent the vehicle to a third party for the remaining period. The hirer can avoid cancellation fees by taking travel insurance cover, subject to the terms and conditions of the insurer.
2. Rental Rates
The rental rates and ancillary fees are defined by the current price list at time of reservation.
3. Payment terms
At time of reservation, at the latest within 8 days of reservation, an advance payment of 30% of the total rental cost is required. If the advance payment has not been received within 8 days of reservation the lessor is no longer obliged to uphold the reservation. The remaining balance plus the damage deposit are due no less than 8 days prior to the confirmed commencement date of rental.
4. Handover and Return
The vehicle can be picked up at the agreed time and date at the rental location of the lessor. The hirer is obliged to return the vehicle on the agreed date to the agreed location during the regular opening hours, unless other arrangements have been confirmed.
5. Damage Deposit
At the time of rental a damage deposit needs to be paid, to cover for damages and the cleaning of the vehicle after rental. The deposit corresponds to the level of damage excess arranged in the rental contract. If no other agreement has been made the damage excess amounts to €1000,- for caravans and €1000,- for motor caravans. The damage excess for third party fire and theft claims is €160,-, unless otherwise confirmed. Payment can be made in cash or by euro-cheque. At the time of handover a
documentation of the condition of the vehicle will be made, which will include any existing damages to the vehicle. When the vehicle is returned in order without any other damages than noted on the handover documentation, the hirer shall receive a full refund of the deposit. The vehicle is handed over in a clean condition with a full fuel tank. Likewise the vehicle is to be returned clean with a full fuel tank. If the vehicle has not or only been partially cleaned then the hirer is obliged to pay the cleaning
charge, which is explicitly part of the rental contract. The cleaning charge is documented in the current price list at time of reservation. The hirer may justify a lower cleaning charge; the lessor may justify a higher cleaning charge.
6. Drivers:
The hirer and all drivers must be over the age of 21 and have a valid driving license for the vehicle class rented for at least one year prior to rental. For motor caravans a German driving license class 3 or B or equivalent is required unless the motor caravan exceeds a maximum weight of 3,5t and hence requires a driving license class 3 or C. Please note, that for a caravan
newest regulations may require the driver to have a trailer license BE for driving a combination of car with a caravan over 750 kg. The vehicle may only be driven by the following persons: the hirer, any driver named in the rental contract, a direct relative of the hirer or any driver professionally employed by the hirer, subject to the driver having the required driving permit for the vehicle hired. The drivers are regarded legally as agents of the hirer. The hirer is regarded legally as the registered keeper for the duration of the rental and is thereby responsible for ensuring the roadworthiness of the vehicle.
The hirer is not permitted to use the vehicle as follows: for participating in any motor sporting events; for conducting vehicle tests; for transporting any explosive, inflammatory, toxic, poisonous, radioactive or any other dangerous materials; for committing any customs or other criminal act, even if these are only minor offences in the place of commitment; for subletting
or lending the vehicle for commercial use, unless otherwise permitted within the rental contract; or for other uses which are not covered in the contract.
7. Accident and breakdown recovery cover / Excluded countries of use The hirer is obliged to take out insurance cover for national and international break down and accident recovery. The use of the vehicle is only permitted within Western Europe and the European Union. The use of the vehicle in eastern European countries and countries of the former Soviet Union needs
to be permitted by the lessor in writing prior to departure. For use of the vehicle outside of Western Europe (e.g. Russia, Asian turkey, Tunisia, Israel, Morocco) a specific written agreement needs to be made which also includes specific insurance cover.
8. Custodial Liability
The hirer is obliged to use the vehicle and all of its equipment with great care and in accordance with its manuals. Further the hirer must follow all regulations and technical requirements, in particularly regarding the servicing of the vehicle. The vehicle is to be kept locked when the hirer or his accompanying persons are not directly with the vehicle. The hirer is further liable to comply with the traffic regulations of the respective countries of travel.
9. Maintenance and Repair
All costs for running the vehicle are borne by the hirer (i.e. fuel, road tolls). The costs for maintenance and repair are borne by the lessor. Repairs which are required to keep the vehicle operational and road safe up to a sum of €100,- may be authorized by the hirer. Any repairs over €100,- must be authorized with the written consent of the lessor. The costs for repairs will
be reimbursed by the lessor subject to submission of a legally acceptable V.A.T. invoice, provided that the hirer is not liable for the damage (see clause 10).
10. Hirers Liability
The hirer is liable to return the vehicle on time and in the condition outlined in the contract. The hirer is liable for any damages and loss of the vehicle. Subject to the eligibility for insurance cover, the liability is limited to the contractually agreed damage excess. The liability of the hirer is not limited if the insurer will not provide cover, in particularly when the hirer or driver
caused the damage by malice or gross negligence, under the influence of alcohol or drugs; failed to report the accident, fire, theft, game- or other damage to the responsible police authority (see clause 12.); or if the driver has no valid driving permit or is not permitted to use the vehicle. Further no insurance cover exists for damages caused by failing to obey height
restrictions (German traffic regulation sign 265 §41 Passage II No. 6 StVO).
The hirer is fully liable for damages caused by a hit and run accident, by passing the vehicle to unauthorized drivers or by failing to comply with clauses 6 and 8, unless the incident has no influence on the insurance payment. The hirer is also responsible in full for all damages caused by not using the vehicle in accordance with the contract and improper use of the
vehicle and its equipment.
11. Lessors Liability
The lessor is liable to provide the hirer with the confirmed vehicle, as long as it is possible with his means. In the case of failure to provide the vehicle the hirer’s liability is limited to 10 times the net daily rental. The hirer is permitted to provide a similar vehicle to the reserved vehicle, subject to the reserved vehicle being unavailable at time of pick-up or during the rental
period for reasons beyond the control of the lessor. The lessor can not be made liable for collateral damage. The lessor is not obliged to store items which the hirer leaves in the vehicle upon return.
12. Procedures in case of incident
In case of accident, theft, fire, game or other damage the hirer is obliged inform the police immediately. This is also required for self caused accidents without damage to a third party. The hirer will be made liable for the full damage in case of failure to report the incident to the police (see clause 10.).
No statements of liability may be given towards any third party. The hirer is obliged to immediately provide the lessor with a detailed damage report including a drawing; this is also required for minor damages. The damage report must include the name and address of any involved parties and any witnesses as also the registration number of any involved vehicles. If the
damage is likely to exceed the excess, or if the vehicle is no longer road worthy the lessor is to be informed immediately by telephone. Should the tachometer fail, the vehicle is to be driven to the nearest garage and repaired immediately.
13. Storage of personal data
The lessor is permitted to store and use the data regarding the hirer and the drivers in accordance with German data regulation laws insofar that it pertains to the rental contract, regardless of whether the data originates from the lessor or a third party.
14. Jurisdiction
The jurisdiction is the business location of the lessor. This applies when both parties are business contacts or at least one of the parties is not located in Germany, moves their location out of the jurisdiction of the German courts or has an unknown address. This procedure also applies for bills of exchange and cheques. Legally binding are the terms and conditions in
German language.
15. Final provisions
Other agreements have not been made, verbal statements do not apply. Should any clause of these terms and conditions not be valid or become invalid, then this does not influence any other clause of the document. Any potentially invalid points are to be interpreted, such that they fulfill the original meaning of the clause. This does not apply when compulsory legal
requirements are forfeited.

We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
